Terms of Service

These terms govern your use of BeeBrand: the website at beebrand.us and the application at panel.beebrand.us (together, the "Service"). The Service is provided by PurpleClear LLC ("we", "us"). By creating an account or using the Service you agree to these terms. If you use it for an organization, you agree on the organization's behalf and confirm you may do so.

1. Accounts

You sign in with a Google account, and you must be at least 18. Keep your Google account and any second factor secure; you are responsible for what happens under your account. Tell us promptly at privacy@beebrand.us if you suspect unauthorized use.

2. Organizations, members and guests

An organization's owners and administrators decide who joins it, what each member can do, and which guests are invited into client chats. The organization is responsible for its members' and guests' use of the Service. Invitation, share, calendar and report links work for anyone who holds them, so share them with care and revoke the ones you no longer need.

3. Plans and payment

The Service is offered on a free plan and on paid plans, with the limits and prices shown on our pricing page. Paid plans are billed in advance for each billing period through our payment processor, and fees are non-refundable except where the law requires otherwise. The non-profit plan is available to organizations that give us proof of their status, and we may withdraw it if they do not qualify. We may change prices or plans. Any change to what you pay takes effect from your next billing period, and we will tell you before it does. If you exceed a plan's limits, you may be unable to add more until you upgrade or free up capacity.

4. Your content

You keep all rights to what you and your team put into the Service ("Your Content"). You give us permission to host, copy, process, transmit and display Your Content only as needed to provide the Service to you, to keep it secure, and as described in our Privacy notice. That includes sending it to our AI model provider when you use an AI feature. You confirm you have the rights to Your Content, and that putting it into the Service breaks no law and no one else's rights.

5. Acceptable use

You agree not to:

• use the Service for anything unlawful, or to store or share content you have no right to share;
• upload malware, or try to reach another organization's data or any part of the Service you are not permitted to use;
• probe, scan or test the Service's security without our written permission;
• overload, disrupt or scrape the Service, or get around its limits;
• resell or sublicense the Service except as we agree in writing.

6. AI features

AI-generated summaries, analyses and suggestions are produced automatically and may be incomplete or wrong. Review them before relying on them. You are responsible for decisions you make with them.

7. Third-party services

The Service works with services we do not control, such as Google sign-in, and it opens websites you bookmark. Their own terms govern your use of them, and we are not responsible for them.

8. The Hive and Beekeepers

The Hive is small groups of people starting a business at the same time. Beekeepers are accountants, lawyers, marketers, founders and other professionals listed in BeeBrand to help them.

• Beekeepers are independent. They are not our employees, agents or partners, and we do not supervise their work. Each Beekeeper sets and charges their own fees; you agree terms with them and pay them directly.
• We only connect people. PurpleClear LLC takes no commission from any Beekeeper's fee, is not a party to any agreement or payment between you and a Beekeeper, and is not responsible for the quality, legality or outcome of their services. Beekeepers pay us a flat listing fee, which never affects the order they are shown in.
• No professional advice from us. Nothing in the Hive, the Beekeepers directory or anywhere in the Service is legal, tax, financial or other professional advice from PurpleClear LLC. Advice you get from a Beekeeper is theirs.
• Be decent in the Hive. No harassment, spam, self-promotion outside the Beekeepers directory, or sharing other people's personal information. We may remove messages and members who break this, and anybody can report a message to us.
• Referral tokens. Every person has a referral link. You earn one token when somebody new creates a BeeBrand account through your link within a day of following it; one token per new account, never for yourself or for an existing account. You can give tokens to a Beekeeper, who can apply each one as $10 against their listing fee. Tokens have no cash value, cannot be sold or exchanged for money, and we may cancel tokens earned by abuse (for example, accounts made only to earn them).

Beekeepers also accept the separate Beekeeper Terms.

9. Changes and availability

We are continually improving the Service and may add, change or remove features. We aim to keep it available but do not promise it will be uninterrupted or error-free. If a change significantly reduces a paid plan, we will tell you in advance.

10. Ending your use

You may stop using the Service at any time. We may suspend or end access if you seriously or repeatedly breach these terms, if you fail to pay, or if the law requires it. Where we reasonably can, we will warn you first and give you the chance to export Your Content.

11. Disclaimers

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. This includes warranties of merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the extent the law allows, PurpleClear LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim and (b) US $100. Some jurisdictions do not allow these limits, so they may not apply to you.

13. Indemnity

You will defend and indemnify PurpleClear LLC against third-party claims arising from Your Content or from your breach of these terms.

14. Governing law

These terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. The state and federal courts located in North Carolina have exclusive jurisdiction over any dispute arising from them, and you and we consent to those courts. Nothing here removes rights you have under the mandatory consumer-protection laws of the place where you live.

15. Changes to these terms

If we change these terms, we will update the date at the top. If a change is material, we will tell you before it takes effect. If you keep using the Service after that, you accept the updated terms.

16. General

These terms and our Privacy notice are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. If we do not enforce a right, we have not waived it. You may not transfer these terms without our consent. We may transfer them as part of a merger or sale.
